ChickenCoopsDirect.com has taken every care in the preparation of the content of this Website, in particular to ensure that prices quoted are correct at time of publishing and all products have been fairly described. However, we reserve the right to change prices, descriptions, modify, or substitute products without notice. Any orders received represents an offer to buy products indicated by you and is not a binding contract until we have dispatched the goods. This means that if the price, description or any other information about a product is incorrect we are not obliged to sell you the product. We reserve the right to cancel your order up to and including the estimated day of delivery.

All prices are displayed inclusive of VAT unless stated otherwise, and where applicable. Packaging may vary from that shown. The weights, dimensions and capacities given are approximate only. We have made every effort to display as accurately as possible the colours of our products that appear on the Website. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery. Thirty Four Stores Ltd shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials on this Website.

4. Availability
All items are subject to availability. We will inform you as soon as possible if the goods you have ordered are not available.

5. Payment, Acknowledgment and Acceptance of your Order
We do not store credit or debit card details nor do we share customer details with any 3rd parties. Please note that completion of the online checkout process does not constitute our acceptance of your offer to purchase products or services from us. Our acceptance of your order will take place only when we dispatch the product(s) that you ordered from us.

We will notify you by email as soon as possible to acknowledge that we have received and are processing your order. The duration of our contract with you will start from when you order and we take payment and dispatch the products, until the last day of your right to cancel. If we cannot supply you with the product you ordered, we will inform you of this in writing (including email) and, if you have already paid for the product refund you in full as soon as reasonably possible.

During the checkout process, you will be asked to enter your payment details. By completing your payment details you confirm that the credit or debit card being used is yours. All fields indicated as compulsory must be completed. All card payments are subject to authorisation by your card issuer. We take payment immediately for most products.

All products ordered will remain the property of Thirty Four Stores Ltd until we have delivered the products to the address specified by you. If your payment is not received and you have already received the products you ordered from us, you must pay for or return those products to us in accordance with our reasonable return instructions and in the same condition that you received them at your own expense. If you do not do this within 30 days of the date on which we cancel your order, we may collect or arrange for collection of the products at your expense. We reserve the right to charge you for any and all damage to (or other adverse interference with) any products that are the subject of an unpaid order.

6. Cancellation Right
You have the right to cancel (under the Consumer Rights Directive 2011/83 as implemented in the applicable EU member state ("CRD")), all or part of your contract at any time up to 14 calendar days after the day on which you receive the goods.

Any paid delivery charge will be included in your refund once we have received all of your. Please note the delivery charge refund will be to the value of standard delivery. Thirty Four Stores Ltd will process your refund within 14 days of receipt of the products.

You must take reasonable care of the goods while in your possession and they must be returned to us in or with their original packaging (at your own expense) before we can issue your refund. If you do not return the goods as required, we may charge you our direct costs of recovering the goods.

You may cancel your order for a full refund prior to your order being dispatched. If you cancel your order after this time you are responsible for returning the product back to us in a saleable condition at your own expense. If you refuse to accept delivery of your order for any reason other than the product being visibly damaged, you will be liable for all return freight charges incurred by your refusal.

Any refunds given by us will be made to the debit/credit card account or by cheque (as applicable) provided when you placed your order and will be subject to our right to withhold amounts for products which are damaged on return or for which we arrange collection, as outlined above.

Where we deliver products to a third party in accordance with your order, you will only be able to exercise this cancellation right if you can return the goods to us.

If you wish to return (or are considering returning) a product or service you have ordered from us, please be aware of the following terms that apply:

  • You must ensure that they are properly packed, securely packaged and labelled with our correct address;
  • You are responsible for any damage in transit that is due to incorrect packing or inadequate packaging by you;
  • You are responsible for any damage or loss in transit where you arrange the transport.

If you choose to return any products to us, we will not be responsible for any loss or damage to them in transit and, for this reason, we recommend that you use a recorded delivery service. If returned products are lost or damaged in transit, we reserve the right to charge you (or not to refund any amounts attributable to) such loss or damage.

If you return goods because you think they are faulty goods, we may charge you the cost of all transport and our actual costs and expenses in the event that the goods are not in fact faulty goods.

8. Damaged and Faulty Goods
If a product arrives damaged, broken or with a fault, we will (at our discretion) either send out replacement parts to you (if possible) or offer you a replacement product. We reserve the right to cancel the contract and arrange for the collection and refund of the damaged or faulty products.

You must notify us within 72 hours if you discover that any goods are faulty or have arrived damaged.Failure to do so may result in the rejection of any damage in transit claims.

In these terms and conditions faulty goods means any goods we supply to you that do not conform to the contract. Faulty goods does not include any goods that are faulty due to fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than in accordance with their intended use, failure to follow the manufacturer's or our instructions, or any alteration or repair carried out without the prior approval of us or the manufacturer.

9. Product Care
It is important to note that our range of chicken coops are made from a natural material that expands and contracts depending on the weather and will need regular and ongoing maintenance to prolong their life. Our wooden chicken coops are treated with an animal friendly base coat of wood preservative. This is only a base coat and we strongly recommend that you treat your product with a high quality animal friendly varnish or wood preservative as soon as possible, preferably before it comes into contact with any heavy rain and that you re-treat your hutch at least once a year (preferably before the winter season) to maintain the applied preservative and water repellent properties. We also recommended that you position your chicken coop in an area that is well protected and not exposed to the elements. We will not accept any responsibilty or claims for products that have not been well maintained or have been left without protection.

10. Delivery 
Any dates specified by Chicken Coops Direct for delivery of the Goods are intended to be an estimate and time for delivery shall not be made of the essence by notice. If no dates are so specified, delivery shall be within a reasonable time.

Where the supply of your product(s) is delayed or prevented for reasons beyond our control (for example, material shortages, import delays or higher than anticipated demand) we will make every effort to keep you informed but shall be under no liability to you for such delay or failure.We shall be under no liability for any delay or failure to deliver products if the delay or failure is wholly or partly caused by circumstances beyond our control.

If you miss the delivery of your order or we are unable to leave your order as you instructed (because the driver was unable to gain acccess to the property or there was nowhere safe to leave the items), you may incur a re-delivery charge as we have met our original delivery obligation with our first attempted delivery.

All delivery times quoted on the product pages and on our web site are estimated delivery times only and cannot be guaranteed.

All risk in the products you order (including risk of loss and/or damage to the products) shall pass to you when they are delivered to the delivery address specified in your order.

Once your order has been delivered please open it within 72 hours after receipt and inspect the contents for any sign of damage that may have occured during transit. Failure to do so may result in the rejection of any damage in transit claims

11. Exclusions of Liability
Any disclaimers and exclusions of liability in these terms & conditions shall not apply to any damages arising from death or personal injury caused by the negligence of ChickenCoopsDirect.com or any of its employees or agents or fraud. These disclaimers and exclusions shall be governed by and construed in accordance with Law. If any provisions of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
